This Privacy Statement ("Statement") applies to the website located at www.starbucks.vn and any other websites or applications, if applicable, including mobile applications associated with Starbucks brands or products that direct the viewer or user to this Statement. In this Statement, the terms “Starbucks,” “we,” and “us” refer to Viet Idea Food & Beverages Company Limited. The Starbucks websites or applications to which this Statement applies may contain links to other websites or applications owned and operated by other companies. However, this Statement does not apply to such third party websites or applications, and we are not responsible for the protection of your personal information by such other companies, but you are solely responsible for your own access via such links.

We undertake to protect and respect your privacy. This Statement explains how we process your personal information. If you do not agree with this Statement, you are not permitted to use any of our websites, applications or services.

  1. Information We Process

In the scope of this Statement, “Processing of personal information” means one or more activities affecting personal data, such as: collecting, recording, analyzing, confirming, storing, editing, publicizing, combining, accessing, retrieving, revoking, encrypting, decoding, copying, sharing, transmitting, supplying, transferring, deleting, destruction of personal data or other related actions.

As you use our websites or applications, we process certain personal information about you and the services you use. Types of personal information that we process may include (i) basic personal information such as full name; date, month and year of birth; gender; place of residence; contact address; nationality; photograph of the individual; phone number; identification card number, personal identification number; marital status; information on family relationships (parents, children) and other basic personal information; and (ii) sensitive information such as account number, banking card information, payment transaction information; data on the location of individuals determined through location services and other sensitive information."  

Your personal information that we process is collected from three different sources: (1) information you give us; (2) information we collect from you automatically when you use our services; and (3) information we collect from other sources.

Information You Give Us

We collect information you give us when you use our services. Some examples of using our "services" are when you make a purchase at one of our stores, visit or make a purchase via one of our websites or applications, create a Starbucks account, buy or send a gift certificate or e-gift online, download and install one of our mobile applications or participate in a survey or promotion. You may also give us information in connection with applying for or managing a franchised Starbucks store. The information you give us may include your name or surname; username; password; email address; postal address; phone number; financial account information such as holder’s name, number, expiry date, verification code of credit card, debit card, domestic ATM card; birthday; city of birth; demographic information; and any other information you choose to give us. You may also permit us to access information stored in the “contacts list” on your device or provide us with information regarding the person you direct us to send a gift certificate or e-gift online, if applicable.

Information We Collect Automatically When You Use Our Services

When you access our websites or use our services or mobile applications, we may collect information about your access and use. This information includes:

  • Purchasing Information – We may collect information about your transactions in our stores or on our websites or our mobile applications including what products you purchase, how frequently you purchase them, any rewards or promotions associated with a purchase and the products you have placed on “wish list” for future purchase.
  • Device And Usage Information – When you download and install one of our mobile applications or use a computer, tablet, smart phone or other device to access our websites, use our services or mobile applications or purchase products or services via our websites, we may collect information about the device you use and how you use it.
  • Account Information - Where you make a payment for transactions on our websites or mobile application, we collect payment information from you through our payment service providers in order to facilitate the payment process for you, including the name on your card, your card number, expiry date and verification code.

This information may include the type of device you are using, your operating system, your browser (for example, whether you used Internet Explorer, Firefox, Safari, Chrome or another browser), your internet service provider, your domain name, your internet protocol (IP) address, your device identifier (or UDID), the website that referred you to our website, the web pages you view (including the date and time you viewed them), the services or functionality you access or use (including the date and time of your access or use) and the subject of the ads you click or scroll over.   • Location Information- When you download and install one of our mobile applications, or use a computer, tablet, smart phone or other device to access our websites, use our services or mobile applications, or purchase products or services via our websites, we may collect information about your physical location which may include information based on your IP address, SIM card and/or device’s GPS (global positioning system).

We may combine this information with other location-based information, such as your IP address and invoicing information to give you information about stores near you, provide you with the distance of such stores from your location, and facilitate the operation of other services or functionality on our websites and in our mobile applications. We share your location information only with service providers that help us provide you with these services and functionality or help us understand how these services and functionality are being used. Information We Collect From Other Sources

We also collect information that is publicly available. For example, we may collect information you submit to a blog, a chat room, or a social network like Facebook, Instagram, Twitter or Google+. We may also collect information about you from other companies and organizations. By gathering additional information about you, we can correct inaccurate information, enhance the security of your transactions and give you product recommendations and special offers that are more likely to interest you.

We may share your information in the following circumstances:

When We Work Together – We may share the collected information for Starbucks Corporation and their respective subsidiaries and affiliated companies for recruitment purpose, proper management, analysis and decision-making, including decisions regarding expansion and promotion of our product and service offerings, order or customer request fulfilment, operation of our websites and mobile applications and for other purposes described in this Statement.

When We Work with Service Providers – We may share your information with service providers that provide us with support services, such as website hosting, email delivery, location mapping, postal mail processing, order fulfilment and delivery, and analytics. We require these companies to refrain from collecting, using, and disclosing your information except when they are performing work for us or when the disclosure of your information is required by law.

When We Work on Business Transactions – If we become involved with a merger or another situation involving the transfer of some or all of our business assets, we may share your information with business entities or people involved in the negotiation or transfer.

When Sharing Or Disclosing Is Required by Law Or To Protect Lawful Interests – We may disclose your information as required by law, to enforce our agreements or policies, or to protect the rights and lawful interests, or safety of Starbucks or our customers or partners.

When We Share with Other Companies for Marketing Purposes – We may share your information with service providers to use your information on our behalf to provide you with promotions and special offers, inform you of contests, sweepstakes, events or for other promotional purposes. We also may share aggregated statistics about your use of our websites and applications with other companies.

When You Give Consent – We may share information about you with other companies if you give us permission or direct us to share the information.

When the Information Does Not Identify You – We may share your information in a way that does not directly identify you. For example, we may combine information about you with information about other people and share the combined information in a way that does not link the combined information to you.

When You Post on Our Websites – If you post information on a blog or another part of our websites, the information that you post may be seen by other visitors to our websites, including your post information and your user name.

  1. We May Allow Others to Collect Your Information

When you use our websites or applications, we may allow third parties to collect information about you through cookies, web beacons and other similar technologies. We allow third parties to collect this information on our websites for the following purposes.

To Display Ads for Products or Services – We allow some advertising companies to collect this information in order to display ads on our websites that are most relevant to you. These third parties may also collect anonymous information about visitors to our websites to place them into market segments to display ads on other websites believed to be relevant to each market segment. To Collect Information on How Our Websites and Applications, Are Used – We allow certain service providers to collect this information to help us understand how our websites and applications are used and to assist us in improving the content and operation of our online properties. These service providers collect aggregate statistical usage data that is not matched or linked to any individual user.

To Make the Services of Other Companies Work – We allow companies to implement cookies, web beacons and other similar technologies to enhance the operation of particular services and functionality of our websites or applications. For example, we allow Adobe to set and enable special cookies that are necessary to deliver video content for Adobe Flash Player. These cookies are called Flash cookies.

To Link Your Activity to Your Social Networks – We have added certain features to our websites and applications that allow social networks (such as Facebook, Instagram, Twitter, and Google+) to track the activities of their members or collect certain information when they use our website or applications. These features may include technologies called “plug-ins” and “widgets.” Plug-ins create direct link between two websites and widgets are interactive mini-programs that provide other companies’ services on our websites.   1. Cookies, Web Beacons And Similar Technologies

We and others may use a variety of technologies to collect information about your device and your use of our websites and applications. These technologies include cookies, web beacons, java scripts, entity tags and H™L local storage. Most web browsers can be programmed to accept or reject the use of these technologies in certain circumstances or altogether. Cookies – Cookies are small data files that are sent from a website’s server and are stored on your device’s hard drive either for the duration of your visit (“session cookies”) or for a fixed period of time (“persistent cookies”). Cookies contain information that can later be read by a web server.

Web Beacons – Web beacons are small, transparent images that are embedded in web pages, applications, and emails that are sometimes called “clear gifs”, “single pixel gifs”, “page tags” or “web bugs”. We use web beacons to track the web pages you visit, to test the effectiveness of our marketing, and to find out if an email has been opened and acted on.

Java Scripts – Java scripts are code snippets embedded in various parts of websites and applications that facilitate a variety of operations including accelerating the refresh speed of certain functionality or monitoring usage of various online components.

Entity Tags – Entity Tags are HTTP code mechanisms that allow portions of websites to be stored or “cached” within your browser and validates these caches when the website is opened, accelerating website performance since the web server does not need to send a full response if the content has not changed.

HTML5 Local Storage – HTML5 local storage allows named key/value pairs from websites to be stored or “cached” within your browser in order to store and retrieve data in HTML5 pages when the website is revisited.

These technologies are used mainly for the following purposes:

Services and Functionality – Some of these technologies are required to allow you to access or use our websites or mobile applications and the various services and functionality we offer. Without these technologies, some of the services and functionality we make available on our websites and mobile applications would not work properly.

Performance Monitoring – Some of these technologies help us analyse and estimate traffic and assess the volume of use of services and functionality on websites and mobile applications. They show us how visitors and users interact with our digital properties, whether there are any errors, the degree to which certain web pages, applications, services or functionality are accessed and used and how they are performing or operating. Marketing – Some of these technologies are used to tailor your experience on our website or within our mobile applications by controlling the promotions, advertisements and other marketing messages that may appear when you access or use these digital properties. These technologies also help us learn which services and functionality you are using and how you are accessing information about us. Promotional Communication Choices

You can opt out of receiving promotional, advertising, emails, newsletter, text messages, telephone calls, and mailings by informing us of your preference at the time you sign up for a Starbucks account, modifying your promotional preferences online in your account’s profile management section or by following the opt-out instructions in the promotional emails we send you. Where our mobile applications allow for the delivery of “push notifications” you can also opt out of receiving these notifications by toggling the “Push Notifications” switches within our mobile applications to "Off."

Information Collection Choices

Location Information – You can adjust the settings of your computer, tablet, smart phone or other device so that information about your physical location is not communicated by (a) disabling “location services” within the device settings; or (b) denying certain websites or mobile applications permission to access location information by changing the relevant preferences and permissions in your mobile device.

Use of Cookies - As required, we offer the option to reject the use of cookies when you first access our websites. If you do not reject the use of cookies at this time, your continued use of the website will be treated as consent to the use of cookies. If you reject the use of cookies at this time, we will not set any further cookies on your device, except those required to allow you to access or use our websites or mobile applications and the various services and functionality we offer.

Cookies, Web Beacons and Similar Technologies - You may reject the use of most cookies, web beacons, entity tags and HTML5 local storage by adjusting the appropriate settings in your browser. Each browser is a little different, but the most common browsers (Internet Explorer, Chrome, Firefox, and Safari) have preferences or options that may be adjusted so the browser notifies you if a website wants to set or install a cookie or similar technology and allows you to either accept or reject the cookie or other technology before it is set or installed or allows you to remove or reject the use or installation of these technologies altogether. Flash Player Technology - We allow Adobe to set and enable special cookies and Java Scripts associated with the delivery of video content for Adobe Flash Player. While Flash cookies and Java Scripts cannot be removed by changing the browser settings, you can limit the websites that can deploy Flash cookies and Java Scripts on your device by visiting the Adobe website:

“Do Not Track” Technology – Some newer web browsers have a “Do Not Track” preference that transmits a “Do Not Track” header to the websites you visit with information indicating that you do not want your activity to be tracked. We currently do not respond to browser “Do Not Track” signals

  1. Accessing or Changing Your Information or Deleting Your Account

  • Request for providing your personal information. You may request us to provide your personal information that is in our handle, accordingly, you will receive a copy of your personal information that we have collected.
  • Access to view, correct or request to correct your personal information that is in our handle.
  • Object to processing of your personal information. You may object to our processing of your personal information by sending us your objection in accordance with provisions of this Statement.
  • Request for deleting your personal information or your account. You may request us to delete your personal information that is in our handle. If you request us to delete your personal information or your account, we will cease using your personal information and immediately remove the same from our database upon your request, unless required by law, court, or agency or administrative authority to retain such information for other purposes. Please note that if you request us to delete your personal information or your account, you will no longer be able to use our services. You agree to indemnify and hold us harmless from any claims, legal liabilities arising from our deleting your personal information or your account at your request.
  • Request for restriction of processing of your personal information. You may request us to restrict or cease the processing of your information. This may lead to the result that you will no longer be able to use a part or all of our services after we have restricted or stopped processing your personal information as your request.
  • Right to provide your personal information to others. You may share by yourself or authorize us, subject to our sole descretion on acceptance of such authorization, your personal information that in our handle with any other party. You are solely responsible for such sharing of your personal information with such other party whether by you or by us on your behalf under your authorization already accepted by us. You agree to indemnify and hold us harmless from any claims, expenses, legal liabilities arising from your or our on your behalf such sharing of your personal information with such other party.

We provide you with the right to access so that you can review and make certain specific modifications to your personal information. In addition to such access and modification right, any your requests regarding your personal information that is in our handle can be made by contacting us as described in the “Contact Us” section, below. We will make every effort to promptly respond to your request. We will retain your information for as long as your account is active or as needed to provide you services.

  1. How We Protect Your Information

Starbucks protects your information using technical, physical, and administrative security measures to reduce the risk of loss, misuse, unauthorized access, disclosure or modification of your information in accordance with the Laws. Some of our safeguards include firewalls, data encryption, physical access controls, and administrative informational controls. When you transmit highly sensitive information (such as a credit card number) through our websites or via our mobile applications, we encrypt the transmission of that information using the Secure Sockets Layer (SSL) protocol.

However, while we have employed security technologies and procedures to assist safeguarding your personal information, you aknowledge and agree that there is no perfect security system, and due to the inherent nature of the Internet, it is impossible for us to guarantee that data, including personal information, is absolutely secured from unauthorized intrusion or access by others. You are responsible for protecting your password(s) and maintaining the security of your devices. Please do not disclose someone else your sensitive information such as account information, password, your credit card/debits card/domestic ATM card. In the event of an unexpected transaction occurred, please contact our Starbucks Rewards™ Customer Care Center so that we will make our best effort to assist you in prevention of any consequences of this incident, but not have any liability arising from such incidents

  1. Time of Storing and Processing Your Information

We store your personal information for the duration needed to accomplish the purposes specified in this Statement or to meet or to comply with the legal requirements, including record retention, resolving dispute and enforcing our agreements, or complying with accounting and auditing regulations. Our storage of your personal information is governed by the applicable laws of Vietnam. This storing period may extend beyond the term of your relationship with us.

When there is no longer the legitimate reason to store your personal information, your personal information will be deleted, destroyed pursuant to the procedures established in relation to our relevant systems and in accordance with applicable laws.

  1. Transfer of Your Information Abroad

The information you provide us is stored and processed on servers owned or controlled by Starbucks and other companies in Vietnam, the United States and/or the United Kingdom. Some of the companies or other organizations who may handle your information are located outside the European Economic Area (EEA), in countries that do not provide the same level of protection as countries in the EEA. The United States is one of the countries that provide less protection than countries in the EEA. Regardless of the company or person who processes your information and where it is processed, we will take steps to protect your information in accordance with applicable data protection laws and this Statement.
